Words fail me on this one. My client has indicated that he will actually die because of Mr. Tsivyan's litigation conduct-- and I agree! I'll put this up at my earliest opportunity.

His bad conduct is illustrated in a recent motion filing where he sought to have my client sanctioned for writing checks to his client "in the wrong name." The checks are $50 per month for installments of an attorney fee award in his client's favor. My client was writing the checks as "Natasha Klein-Atlas" instead of "Natalya Klein-Atlas." She has used both names. The total amount at issue was $500. Michael admitted that Natalya didn't even try to deposit the checks, and she didn't even sign the motion. This situation is covered by UCC 3-204(d), which lets a payee endorse a check in the wrong name under either the name written or the actual name of the payee. In other words, this motion was frivolous because she could have deposited the checks. Can't believe Michael didn't get sanctioned for that, which is ridiculous considering that it cost more in attorney time to prepare and oppose the motion than was even at issue. But in any case, this shows that all he cares about is manufacturing disputes and attorney work in order to rack up fees. His client doesn't even need the money. It makes a big difference to my client, who is suffering from being disabled, unable to work, and the target of endless litigation.
